1. General information

1.1 These general conditions (the "General Conditions") are governed by Legislative Decree 6 September 2005 n. 206 ("Consumer Code") containing the provisions for the protection of consumers and in particular by articles 50 to 68 relating to distance selling.


1.2 The General Conditions apply to purchase orders for products issued online on this website (www.sicurink.com) for deliveries to be made exclusively in Italy (including the Republic of San Marino and the Vatican City), France , Germany and Belgium.


1.3 By ticking the box "I accept the Terms of Service and I will adhere to them unconditionally" that appears during the purchase procedure, the Customer accepts all the contractual conditions set out below. In the absence of express acceptance of the General Conditions, it will not be possible to complete the online purchase procedure.


1.4 DAMIANI Srls reserves the right to modify the General Conditions at any time without notice. However, the changes will have no effect on purchase orders that have been sent before the publication of the changes on the Site.


1.5 For the conditions of use of the Website and the privacy rules, please refer to the "Terms & Conditions of the Website" as well as the "Privacy Policy" below.


1.6 By accepting the General Conditions and therefore by issuing the purchase order, the buyer gives his consent for all communications to be sent and received by e-mail. The cost of using the communication technology depends on the tariff charged by the Internet service provider.


1.7 The buyer will be responsible for the correctness of the e-mail address and for all the information entered when issuing the order or when opening an account.

2. Issue of the order and conditions of purchase

2.1 The Customer can purchase the Products by accessing the pages of the Site. The purchase order will be automatically issued at the end of the order issuing procedure. Only the Products marked as available in the online catalog of the Site at the time the order is issued can be purchased.


2.2 The correct receipt of the order will be confirmed by DAMIANI Srls by e-mail communication sent to the e-mail address provided by the Customer. The confirmation message will contain the essential characteristics of the purchased good, the quantities, the unit prices of the purchased products including additional taxes and duties, delivery costs, payment and delivery methods. The confirmation message will contain the identification reference (9 capital letters) of the order to be used in any subsequent communication with Damiani Srls.


2.3 DAMIANI Srls will ship the Products available in the warehouse on the working day following receipt of payment for the order placed.


2.4 In the event of non-execution of the order due to unavailability - even temporary - of the Products, DAMIANI Srls, within thirty days of receipt of the order, will inform the Customer by e-mail communication to the e-mail address and will consequently to re-credit any sums paid.


2.5 The minimum amount that can be ordered is €1.00 including VAT.


2.6 If the payment method chosen is the advance bank transfer, the buyer must make the payment within 5 (five) days of receipt of the order confirmation sent by DAMIANI Srls by email. Otherwise DAMIANI Srls will consider the order void by communicating the dispute to the buyer.


2.7 The order will be filed in the DAMIANI Srls database for the time necessary to execute it and in any case in accordance with the law. The registered user will be able to access the history of orders placed through his personal account.


3. Delivery

3.1 The delivery times of the goods to the Carrier will depend on the payment method chosen by the Customer. After payment of the order, the goods will be handed over to the carrier and delivered to the customer within an indicative average time of 3 - 7 working days following the accounting date of the payment chosen by the customer. In no event can DAMIANI Srls be held responsible for delayed or non-delivery.


3.2 DAMIANI Srls may, at its discretion, decide to make multiple partial deliveries. In this case, the Customer will not be burdened with any additional cost compared to that foreseen for a single delivery.


3.3 The Products ordered will be delivered in the original design however DAMIANI Srls, upon notice from the supplier, reserves the right to make changes to the Products that do not alter or improve their functionality.


3.4 If delivery is not possible, within thirty (30) days, you may cancel your order. If all payments have been made, they will be returned by us within 30 (thirty) days.


4. Prices and delivery costs

4.1 All the prices of the Products contained in the online catalog are expressed in Euros. The Products are sold at the list prices in effect at the time the order is issued.


4.2 DAMIANI Srls reserves the right to vary the shipping costs subject to an estimate or telephone notice for deliveries to particularly disadvantaged logistically locations.


4.3 The Customer undertakes to reimburse DAMIANI Srls for any additional expense that the same has had to incur for shipments or handling caused by a failure by the Customer to comply with the agreements made for the date, time and place of delivery.


5. Payment

5.1 Payment for the Products can only be made via:


PAYPAL (only for those who already have a PayPal account)



5.2 DAMIANI Srls allows the buyer to make the online payment in absolute safety thanks to an automatic encryption system of the entered information and the assistance of an external provider.


5.3 The data relating to the credit card will be provided by the Customer during the order issuing procedure.


6. Right of withdrawal, non-compliant products

6.1 The Customer has the right to withdraw from the purchase contract - without any penalty and without specifying the reason - within the term of 14 (fourteen) days from the date of delivery of the Product pursuant to Legislative Decree 21/2014.


6.2 The right of withdrawal can be exercised by sending an email to the address below, within the term indicated in point 6.1 above, provided that the product has not been opened or used in any way.

Once the email has been sent, wait for the response from the Returns Office which will indicate to which address to send the goods to be returned.


6.3 The substantial integrity of the Product to be returned is an essential condition for exercising the right of withdrawal. The right of withdrawal, therefore, cannot be exercised if the Customer has not taken adequate measures to ensure that the Product can be returned in the same condition in which it was received (including the original packaging). In any case, the Product must never have been installed and/or used. The Customer must therefore take all appropriate and possible measures to return the Product to DAMIANI Srls in perfect condition.


6.4 The Customer who has exercised the right of withdrawal is required to return the Product within 10 (ten) days of confirmation of acceptance of the Return by DAMIANI Srls to:

6.5 The costs for shipping and returning the Product will be the sole responsibility of the buyer.


6.6 Products marked with free shipping have a transport cost included in the price which will not be refunded in case of withdrawal.


6.7 In the event that the Customer has already made one or more payments, these will be reimbursed by DAMIANI Srls within the term of 14 (fourteen) days from the date of receipt of the returned goods. Fees relating to payments made via PayPal will not be refunded.


6.8 Except as established for the right of withdrawal, the Customer will also have the right to resort to legal remedies provided for by Part IV Title III Chapter I (from articles 128 to 135) of Legislative Decree 6 September 2005 n. 206 ("Consumer Code") relating to any lack of conformity of the Product existing at the time of delivery.


6.9 Any lack of conformity of the Product must be reported to DAMIANI Srls within 24 hours of delivery to the e-mail address indicated in point 1.8.


7. Installation and use

7.1 Accessories and consumables purchased online must always be installed and used in compliance with the instructions and warnings provided in the User Instruction Manual.


7.2 The Customer is responsible for the correct installation and correct use of the Products purchased online.

ATTENTION: the installation of some Products requires the intervention of authorized and professionally qualified personnel in order to avoid the risk of damage to the structures and/or injury to persons, with particular reference to the installation, use and maintenance of components for use of gas, electrical equipment, hydraulic parts and components. Always read and follow the Instruction Manual and/or the instructions on the packaging of the Products ordered.


7.3 DAMIANI Srls assumes no responsibility for complaints attributable (a) to an unintended use of the Product or to its manipulation, (b) to the use and installation with equipment for which the Product was not designed, or (c) incorrect installation.


ATTENTION: use and/or installation carried out in a way that does not comply with the instructions provided can cause harm to people


8. Force majeure

8.1 DAMIANI Srls will not be held responsible for failures or delays in the execution of the order in the event that such failures or delays are caused by impediments such as work interruptions, union unrest, suspension of transport and any other cause that may integrate an impediment due to force majeure or unforeseeable circumstances.


9. Governing Law

9.1 The General Conditions are governed by Italian law.


9.2 For any dispute relating to the General Conditions, the court of residence of the Customer will be competent, in the event that he is a consumer.


10. ADR

According to article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer can make use of the Joint Conciliation procedure. The Procedure can be initiated if the consumer, after having presented a complaint to the company, within 45 days, has not received a response or has received a response not considered satisfactory by him.

11. ODR

Warranty terms

All products sold online at www.dgcommerce.it by DAMIANI Srls are covered by the Manufacturer's standard 24-month warranty for lack of conformity, pursuant to Legislative Decree 24/02/2002. To use the warranty assistance, the Customer must keep the sales invoice or the tax receipt that he will receive attached to the delivered package.

All the packaging of the air conditioner units is accompanied by a sticker indicating the product code and serial number. The Customer must detach and keep the sticker indicating the product code and serial number as well as any Warranty Certificate that some Manufacturers apply to the outside of the packaging. In the event that the package does not have the Guarantee Certificate, the purchase invoice will prevail.

If, following intervention by an Authorized Assistance Centre, the defect is not covered by the Manufacturer's standard warranty, the Customer will be charged for any costs of verification and repair required by the Authorized Assistance, as well as transport costs, if supported by DAMIANI Srls.

The legal guarantee, applicable only on the national territory, of 24 months pursuant to Legislative Decree 24/02/2002, applies to products that present a lack of conformity, provided that the product itself is used correctly, respecting its intended use and the provisions of the attached technical documentation. This guarantee is reserved for the Private Consumer (natural person who purchases the goods for purposes not related to his professional activity, or who makes the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, DAMIANI Srls will provide, at no cost to the Customer, to restore the conformity of the product by repairing and/or replacing and/or reducing the price, up until the termination of the contract. If, following intervention by an Authorized Assistance Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02/2002, the Customer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as transport costs if incurred by DAMIANI Srls.

Replacements in the event of DOA (Dead On Arrival: product not working on delivery) take place only if expressly provided for by the Manufacturer. The timing of replacement or repair of the product depends exclusively on the policies of the manufacturer.

In the event that, for any reason, DAMIANI Srls is unable to return a product under warranty to its Customer (restored or replaced), DAMIANI Srls will be able to proceed at its discretion with the refund of the entire amount paid or with its replacement with a product of equal or superior characteristics.

No damage can be requested from DAMIANI Srls for any delays in carrying out repairs or replacements.

In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ... ).

DAMIANI Srls is not required to provide assistance services in the event of product malfunction. Always contact a specialized assistance center authorized by the manufacturer.
